Borrower Agreement and Liability Release

This Agreement is entered into as of date of submission, by and between:

DoubleCheck Mortgage Review Services (“Company”) and (“Client”).

Purpose: The purpose of this agreement is to outline the scope of services provided by DoubleCheck Mortgage Review Services and to establish the terms and conditions under which these services will be rendered.


1. Scope of Services

The Company agrees to provide the following services to the Client:

  • A review of the Client’s mortgage loan estimate(s) to identify potential errors, unnecessary fees, and other areas of concern including, but not limited to, current market rates.
  • An independent analysis and recommendations based on the loan estimate(s) and closing disclosures(s) provided by the Client.

The Company’s services are advisory in nature and do not constitute financial, legal, or tax advice. Any recommendations provided are made solely in the capacity of DoubleCheck Mortgage Review Services and not in the advisor’s licensed capacity as a loan officer.


2. Client Responsibilities

The Client agrees to:

  • Provide accurate and complete information, including loan estimates, closing disclosures, and other relevant financial documents, for the purpose of review.
  • Not share any third party proprietary documents with the Company.
  • Make all decisions regarding their mortgage loan independently and not rely solely on the Company’s recommendations.
  • Acknowledge that the Company is not acting as a lender, broker, financial advisor, or attorney in this agreement.

 

 

3. Limitations of Liability

  • The Client understands and agrees that the Company is not responsible for the final terms, conditions, or approval of any loan product or agreement entered into by the Client.
  • The Client acknowledges that the Company’s review is based on the information provided by the Client and does not guarantee the accuracy, legality, or completeness of any third-party documentation.
  • The Company shall not be liable for any damages, losses, or claims arising from the Client’s decision to accept or reject any loan product.
  • Any recommendations or analyses provided by the Company are made solely by DoubleCheck Mortgage Review Services and are not affiliated with or representative of the advisor’s licensed role as a loan officer.

4. Indemnification

The Client agrees to indemnify, defend, and hold harmless the Company and its officers, employees, and agents from any claims, damages, or liabilities resulting from:

  • The Client’s reliance on the Company’s review services.
  • Errors or omissions in the information provided by the Client.
  • Any actions taken by the Client with respect to their mortgage loan.

5. Confidentiality

The Company agrees to protect the confidentiality of all documents and personal information provided by the Client in accordance with applicable privacy laws.


6. Dispute Resolution

  • Any disputes arising under this Agreement shall be resolved through mediation before resorting to litigation.
  • If mediation fails, disputes shall be settled in the courts of Colorado.

 

 

7. Termination of Services

Either party may terminate this Agreement at any time, with or without cause, by providing written notice. The Client remains responsible for any fees incurred up to the date of termination.


8. Acknowledgment and Release

By signing this Agreement, the Client acknowledges that they:

  1. Have read and understand the terms of this Agreement.
  2. Understand the limitations of the Company’s services.
  3. Understand that any recommendations provided are made solely by DoubleCheck Mortgage Review Services and are not associated with the advisor’s role as a licensed loan officer.
  4. Release the Company from any liability related to the review of their mortgage loan estimate or closing disclosure.
